ONLINE PAYMENT TERMS AND CONDITIONS

Please read these online payment terms and conditions carefully before using this third party online payment gateway.

1. Who we are

We are Premier Insurance Brokers - L.L.C. - O.P.C (“we”, “ours” or “us”). We are registered in the United Arab Emirates with commercial license number CN-2276972.

Our VAT number is 100536391400003.

We are a licensed insurance brokerage authorized and regulated by the Central Bank of the United Arab Emirates. Our registered address is Muroor Street, Abu Dhabi, UAE.

2. Defined terms

In these payment terms:

2.1 “AED” means UAE Dirhams;

2.2 “chatbot” means the chat tool accessible via the platform;

2.3 “insurance products” means the various insurance products described on the platform, from time to time;

2.4 “insurer” means the provider of insurance products available via this platform. It represents a group of selected insurers incorporated and licensed to offer insurance services in the UAE. The insurer is the party assuming the insurance risk and managing the insurance company’s operations. The insurer’s name will be displayed on the comparison screen and in the associated policy documents relating to you;

2.5 “insurer’s documentation” means all of the applicable terms and conditions for an insurance product, including the policy wording;

2.6 “online payment gateway” means this third party online payment gateway via which you may pay for certain insurance products;

2.7 “payment provider” means First Abu Dhabi Bank;

2.8 “payment terms” means these online payment terms and conditions;

2.9 “platform” means the website located at www.insureone.com, the chatbot and/ or any associated mobile application provided by us;

2.10 “services” means any insurance related services, including, but not limited to, any price comparison tool or procurement of insurance products on your behalf, as defined in the Terms and Conditions for the Supply of Services;

2.11 “UAE” means the United Arab Emirates; and

2.12 “you” and “your” means the individual who intends to use or is using this online payment gateway.

3. Acceptance of payment terms

By using this online payment gateway, you confirm that you:

3.1 are over the age of 18 and reside in the UAE; and

3.2 accept these payment terms, and that you agree to comply with them. If you do not agree to these payment terms, you must not use this online payment gateway.

4. Use of this online payment gateway

4.1 You acknowledge and agree that:

(a) this online payment gateway is a third-party tool operated by the payment provider;

(b) we do not operate, have any control or liability to you in respect of this online payment gateway;

(c) we do not receive, store or use any credit/debit card details or personally identifiable information in respect of the transactions conducted on this online payment gateway;

(d) the payment provider is liable for any failings, malfunctions or errors in respect of this online payment gateway; and

(e) you are responsible for protecting yourself from fraudulent activity in respect of your credit/debit card.

4.2 If you make a payment for any insurance products or services available on the platform, the details you are asked to submit will be provided directly to the payment provider via a secured connection. The cardholder must retain a copy of the transaction records and these payment terms.

4.3 All credit/debt card details and personally identifiable information will be received by the payment provider and processed in accordance with its privacy policy.

4.4 The payment provider accepts payments online using Visa and MasterCard credit/debit card in AED only.

4.5 We will not deal with or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE.

5. Refunds and returns

5.1 Any refunds or rebates which you are entitled to will be provided to you by the insurer.

5.2 You acknowledge and agree that you are contracting directly with the insurer for the supply of the insurance products in accordance with the terms and conditions of the insurer’s documentation. Accordingly, any dispute between you and an insurer in respect of any insurance products shall not give rise to any rebate or refund or repayment liability or obligation on our part or the part of the payment provider.This includes the following, whether or not arising in connection with your use of the platform.

(a) the denial, restriction, cancellation or rescission of cover under an insurance product issued by an insurer via the platform for any reason whatsoever, including fraud, misstatement (innocent, negligent or fraudulent) or non-disclosure by you, willful or otherwise;

(b) any dispute arising in connection with the services, any insurance products or under the insurer’s documentation; or

5.3 You acknowledge and agree that any arrangements or communication with you in connection with this clause 5 shall be implemented and managed by the insurer directly with you and the payment provider shall be under no obligation to assist in any such matter.

6. Amendments and changes

6.1 We may amend these payment terms from time to time. Every time you wish to use this online payment gateway, please check these terms of supply to ensure that you understand the terms that apply at that time.

6.2 The payment provider may update and change the online payment gateway from time to time for any reason without prior notice or any liability.

6.3 We do not guarantee that the online payment gateway will always be available or be uninterrupted. The payment provider may suspend or withdraw or restrict the availability of all or any part of this online payment gateway for any reason without prior notice or any liability.

7. Limit of liability

7.1 Our liability to you in respect of this online payment gateway is limited to the extent permitted by the law of the UAE.

7.2 Different limitations and exclusions of liability will apply to liability arising as a result of the use of the platform, the use of this online payment gateway and the supply of any services and/ or products to you, which will be set out in our Terms and Conditions for the Supply of Services and the Platform Terms of Service.

7.3 We will not be liable to you for any loss or damage (including loss of profit, loss of business, business interruption, loss of business opportunity, and indirect or consequential losses), whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with, amongst other things:

(a) use of, or inability to use, this online payment gateway;

(b) any transactions conducted via this online payment gateway, whether intended or not, or fraudulent; and

8. Jurisdiction and enforceability

8.1 If any provision of these payment terms is held invalid or unenforceable by a competent authority, the remaining provisions will not be affected and will remain valid.

8.2 In the event of a dispute relating to or arising out of these payment terms or the online payment gateway, the laws of the Abu Dhabi Global Market will apply. We both agree that the courts of the Abu Dhabi Global Market will have exclusive jurisdiction.
